These Terms of Service (“Terms”), which include our Terms of Sale, govern your use of sharonalbert.com (the “Site”) and any purchase or commission you make through it. The Site is operated by Sharon Albert (“we”, “us”, “our”). By using the Site or placing an order you agree to these Terms.

The artwork

Sharon Albert creates original, handmade ceramic sculptures. Each piece offered through the Site is made to order and individually crafted to the preferences you agree with us. Because every piece is handmade, no two are identical and there will be natural variation in form, colour and finish. Photographs on the Site are representative of the artist’s work and style rather than the exact piece you will receive.

Prices

Each commissioned piece is priced at €800, plus a flat €50 shipping charge per order. All prices are in Euros (€). We may change our prices from time to time, but the price shown when you place your order is the price that applies to that order. For deliveries outside the destination country, any import duties, taxes or customs charges are your responsibility.

Ordering and the commission process

To commission a piece, place your order and pay through the Site. After your order we will arrange to speak with you — by phone, WhatsApp/video or email — to discuss the style, colours and preferences for your piece. Your piece is then handmade to that specification and delivered to you. Your order is an offer to purchase; a contract is formed when we confirm your order.

Payment

Payment is taken in full at the time of ordering. We accept major debit and credit cards (Visa, Mastercard and American Express), processed securely by Stripe. We do not store your card details.

Bespoke commissions — cancellations and refunds

Because each piece is handmade and personalised to your specification, your order is a bespoke commission. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the standard 14-day right to cancel does not apply to goods that are made to your specification or are clearly personalised. Once your commission is confirmed and work has begun, it cannot be cancelled or refunded. If you wish to discuss changes, please contact us as early as possible and before work begins. Nothing in these Terms affects your legal rights if an item is faulty or not as described.

Delivery

We ship worldwide for the flat €50 charge. As each piece is handmade, timescales vary; we will keep you informed and dispatch your piece as soon as it is complete. Each piece is carefully packed for transit. Risk in the goods passes to you on delivery.

Faulty or damaged items

We take great care in packing, but if your piece arrives damaged or faulty, please contact us within 14 days of delivery, with photographs, and we will arrange a repair, replacement or refund as appropriate. Your statutory rights as a consumer are not affected.

Intellectual property

All artwork, images, designs, text and other content on the Site are the property of Sharon Albert and are protected by copyright. You may not reproduce, copy or use them without our written permission.

Our liability

We are not liable for any indirect or consequential loss arising from your use of the Site or our products. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded or limited under applicable law.

Governing law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
